    Terms of Service

    Last updated: 12 October 2026

    1. About these terms

    fomad.net and Fomad Chatbots are operated by Fomad, a technology business founded by Fowsi Mohamoud Dayib and based in Africa. These terms apply to the website and to the Fomad Chatbots platform. Consulting and development projects are covered by a separate written agreement.

    By creating a Fomad Chatbots account you accept these terms and the Privacy Policy. If you accept them on behalf of a company or agency, you confirm that you are authorised to do so.

    2. Use of the website

    You may use the website only for lawful purposes. You must not:

    • submit false or misleading information through any form;
    • attempt to interfere with the website's operation or security;
    • scrape or harvest content with automated tools without permission;
    • use the forms to send unsolicited commercial messages (spam).

    Sending the contact form does not create a contract. How form data is handled is described in the Privacy Policy.

    3. Fomad Chatbots accounts

    Fomad Chatbots lets professionals and agencies ("you") build, install and manage AI chatbots for businesses they work with ("your clients"). To use it you must be at least 18 years old and give accurate account information.

    You are responsible for keeping your password safe and for all activity in your account. Tell us immediately at info@fomad.net if you think your account has been misused. We may require you to confirm your email address before chatbots can be activated.

    4. Your responsibilities

    • Client authorisation. You only build and install chatbots for businesses that have authorised you to do so, on websites and systems you or they control.
    • Data protection. You and your clients are responsible for the personal data your chatbots collect and use. This includes having a lawful basis, informing website visitors in the client's privacy notice, handling visitors' requests and complying with the GDPR and other laws that apply to you. Fomad processes that data on your behalf as described in section 9.
    • Content. You are responsible for the business information, knowledge and instructions you give a chatbot, and for having the right to use them. Keep prices, opening hours and policies up to date, because the chatbot answers from what you provide.
    • Your price to clients. You set and collect your own fees from your clients. Fomad is not a party to your agreements with clients and does not process those payments.

    5. Acceptable use

    You must not use Fomad Chatbots to:

    • deceive people, for example by impersonating someone else or hiding that they are talking to an AI;
    • collect passwords, payment card details or other sensitive data you are not entitled to process;
    • send spam, phishing, malware or illegal, hateful or harmful content;
    • give professional advice (medical, legal, financial) as if it came from a qualified person;
    • attempt to bypass usage limits, access other accounts or test our security without written permission;
    • resell access to the platform itself or copy it to build a competing service.

    6. AI providers and API keys

    Chatbots run on an AI provider you choose (OpenAI or Google Gemini) using your or your client's own API key. You are responsible for that key, for the provider's charges and for complying with the provider's terms. Fomad does not pay for, and is not responsible for, AI provider usage or costs, including usage that stays within the limits you configure.

    We store API keys encrypted, never show them in browsers or in the chat widget, and only use them to run your chatbots. Remove or replace a key in your provider's account if you think it has been exposed.

    7. Pricing, billing and payment

    • Fomad charges a monthly fee for each active chatbot. Your price per chatbot is shown in your dashboard and may differ between accounts. We will tell you before your price changes; a new price applies from the next invoice.
    • On the 1st of each month we invoice the previous month. Every chatbot that was active at any point during that month is included, even if it was deactivated or deleted before the month ended. There are no refunds or partial charges for part of a month.
    • Invoices are due within 7 days. You pay with one of the methods shown on your Billing page and submit the payment reference there; the invoice is marked paid once we have verified the payment.
    • If an invoice is unpaid 14 days after its due date, your active chatbots are paused until it is paid. While an invoice is overdue you cannot activate chatbots.
    • Until your first invoice is paid, you can run up to 3 active chatbots.

    8. Suspension, termination and account deletion

    You can stop using the service at any time by deactivating your chatbots; billing then ends after the current month. To delete your account, email info@fomad.net. Accounts with invoices are deactivated rather than fully deleted, so that accounting records can be kept as the law requires.

    We may pause chatbots or suspend an account that breaks these terms, puts others at risk or has unpaid invoices. Where reasonable we will warn you first. Fees for periods already used remain payable.

    9. Data processing

    For your account data, Fomad is the data controller. For the data your chatbots process about website visitors, Fomad acts as a processor on your and your client's behalf: we process it only to provide the service, keep it confidential, protect it as described in the Privacy Policy, and help you answer data protection requests. A data processing agreement is available on request at info@fomad.net.

    10. AI answers

    Chatbots are instructed to answer only from the information you provide and to refer visitors to the business when they do not know. AI can still make mistakes. Answers are not professional advice, and you and your clients are responsible for checking important information and for decisions based on chatbot answers.

    11. Intellectual property

    The website, the platform and its code, design and content belong to Fomad. You may not copy or republish them without written permission.

    You and your clients keep ownership of the content you add, such as business information and knowledge. You give us the right to store and process it only to provide the service. Chatbots show a small "Powered by Fomad" link, which must not be hidden or removed.

    12. Availability and disclaimer

    We work to keep the service secure and available, but it is provided "as is". It may be temporarily unavailable for maintenance, updates or reasons outside our control, including outages at AI providers.

    13. Limitation of liability

    To the maximum extent permitted by law, Fomad is not liable for indirect or consequential damages, such as lost profits, lost business or lost data, or for AI provider charges. Our total liability for Fomad Chatbots is limited to the fees you paid us in the 3 months before the event that caused the claim. Nothing in these terms limits liability that cannot be limited by law.

    14. Third-party links and services

    The website and platform link to and rely on third-party services, such as AI providers and payment providers. Their own terms and privacy policies apply to them, and we are not responsible for their content or practices.

    15. Governing law

    These terms are governed by the laws of the country in which Fomad is registered. Disputes are resolved by the courts of that country, unless mandatory law gives you the right to use the courts of your own country.

    16. Changes to these terms

    We may update these terms as the services change. The date at the top shows the latest version. We will email Fomad Chatbots account holders about significant changes before they take effect. Continuing to use the service after that means you accept the updated terms.
